SpaceX has brought a legal action in Texas aiming to stop the release of documents relating to the tax breaks associated with its huge Terafab semiconductor project close to Houston, thereby creating a conflict between corporate confidentiality and public transparency.
The documents that are being asked for consist of SpaceX’s application for tax abatements and the correspondence relating to its negotiations with officials in Grimes County. In July the Texas Attorney General’s Office decided that some of the records and email communications should be made available following two residents of the county having requested them through the Texas Public Information Act.
SpaceX says that the documents contain confidential business information. The lawsuit states that publishing the records could cause the company’s negotiating strategies, concessions and financial limits to be made known to competitors as well as to the government authorities that will be taking part in future negotiations.
The conflict is focused on Terafab, a proposed 100-million-square-foot project for manufacturing semiconductors which is described as a joint venture between SpaceX, Tesla and Intel. Elon Musk has stated that the facility could greatly boost semiconductor production, with the increased output supporting the technology required for AI infrastructure as well as for Tesla’s autonomous vehicles and humanoid robots.
The controversy arises since large data centres and projects related to AI are currently under greater examination regarding the tax breaks they receive, their electricity demand, water usage and the effect they have on the communities around them. There has been a growing number of calls from residents and advocacy groups for more information to be provided about the agreements between technology companies and local governments.
Bucky Brannen, an attorney for SpaceX, said to the residents at a meeting of the county in August that the company had agreed to pay Grimes County about $20 million each year, which is equivalent to around 78% of the amount it would have otherwise paid in property taxes.
The records were first obtained by Marie Egyed and Vanessa Burzynski, who are residents of Grimes County. Since she is a member of the group Grimes County Citizens for Responsible Development, Egyed has opposed the Terafab development and claims that the company’s heightened efforts prevent disre hdocuments’econtentserest in the contents of the documents.
Even though SpaceX is privately owned, the records which have been requested are kept by Grimes County and therefore may be subject to Texas public-records laws.
The case is still not settled and a judge has not yet decided whether the Terafab tax-break records should be released.
